They can and do drop in 09. This expalins why it happens:
The reason mephisto can drop these bugged items is because of a glitch in the game that creates a split second pause between his acctual death and his items dropping (probably something to do with him dropping a quest item... wonder if this would work with that hellforge smith?). He is the only know monster in the game so far with this delay. During the delay, there is a 1:1000000000 chance that there will be lag at exactly the right time, and an item that is about to drop (some unique) will change the unique title, but the item type stays the same because of the lag. When the items drop, POW: legit bugged item with "rolled-down" stats from a different unique. Therefore, this is impossible with any other monster, due to the fact that their items drop instantly at their death. Note that this is ever only known to happen with uniques, not magic/set/rare items.
I did some research on this subject after finding my ring. Youd be quite suprised how many of these bugged items are out there...
